Marbury Suspended; Docked Pay

Stephon Marbury has been suspended for one game -- Saturday against the Golden State Warriors -- and docked the equivalent of one game's salary for refusing to play in Wednesday's game against the Detroit Pistons, according to a person with knowledge of the situation.

ESPN is also reporting the story on its website.

The Knicks are practicing today at 11 a.m. at the MSG Training Center. Marbury will not be there and, as a result of the suspension, will not be at the Garden for Saturday's game, as well. It is expected that the team will look to expedite the process of a separation, but it is unclear exactly what direction they will take. Team president Donnie Walsh is in Indiana with his family for the Thanksgiving holiday. He will be back to attend Saturday's game.

The options include:

* - A buyout, which would have to involve Marbury taking significantly less than the $21.9 million owed to him this season, something he has said he is not interested in doing. We have reported that Marbury recently did offer to take $1 million less, but the Knicks rejected the offer. This is the most mutually beneficial because it would free up a roster spot for the Knicks to either sign a guard or bring in Patrick Ewing Jr., who has been waiting in the wings. It would also allow Marbury to find another team to play for this season.

* - A permanent paid leave, which Marbury would have to agree to. It would mean he would sit out likely the entire season while being paid his full salary. This does not work well for either side because Marbury would go an entire year without playing and then enter free agency with just 24 games under his belt over the past two seasons. It also doesn't work for the Knicks, who would go the rest of the season with 14 roster spots.

Expect the NBA players union to appeal Marbury's lost salary as a result of the suspension.

OK Is it me or does anyone else see that Walsh realizes something is up. If Steph did so much wrong, then why is it a 1 game suspension and dock. Why isn't it stay away for good. 1 game maybe just maybe Walsh sees that coach is at fault as well. THe knicks which is owned by cablevision which also owns newsday have to do something with all the BS going on. You know, I sat down to respond to Alan’s post. This pretty much confirms what I wrote last night, and certainly makes sense from management’s point of view.

Then I started thinking about a feature piece TNT ran last night at about 1:30 am. About Wayman Tisdale. Do you guys know his story?

Apparently, he had a reasonably successful second career as a music producer (and performer?) after leaving the league . . . broke his leg one night walking downstairs for a glass of water . . . only to find out it was bone cancer. After an excruciating 18 months of chemo and rehab, he finds out . . . it didn’t work. They take it off, above the knee.

The point isn’t his troubles; the point is, his amazing attitude about his troubles. And I started thinking about Marbury – a guy who hit the starting line with as much physical talent as anybody. Yet, as others here have pointed out, his main interest isn’t getting back on the court. It’s just about getting what’s owed him. Again, that’s his right. But what a shame. And what a boring story.

Fascinating things are happening with this team, and I’m not just talking about 2010. (Hell, it’s headline news when they win a basketball game.) I’m also not so sure we downgraded in talent with these trades (assuming that Mobley can play, of course). On paper, Zach was probably the most talented player among them . . . yet Zach is nobody’s future. Craw’s talented too. But they have one thing in common. They play as if they’re alone on the court Yes, we gave up a lot of offense but got back at least some defense, and I wonder if the overall team may eventually function better now, in addition to clearing out all that cap space.

The point is, for the first time in years, there’s reason to hope, and there’s reason to watch. One of my hopes is that Walsh isn’t finished yet. If we’ve learned anything it’s that he’s slow, methodical, deliberate. He was criticized for bringing back, in effect, the Isiah All-Stars. But look at the results when he finally makes some moves. C’mon, guys – we’re 15 games into digging out of the Isiah Tar Pits. We knew it would take time. Yet, I’d say things are already improved beyond where I thought they would be so early in the season. There’s lots of cool stuff happening. Yet, for lots of reasons – some of his own making, some out of his hands - Stephon missed that bus. So be it. Wish him the best. See ya. Next . . .

While I'm sure that's right to some extent, you also have to go off of past events. D'Antoni never had a problem with his players anywhere else and Marbury has a history of being a greedy, selfish, coach-killing snake.

As far as Walsh ONLY dealing out one game, I think it's because he's playing it smart. If he goes excessive, the Players Association will have a case against the Knicks and the punishment will be rescinded and the organization might be punishable.

It's a very tight rope to walk. I can't imagine anyone defending Marbury, yet there are some who still do.

The guy is a perennial loser whose teams immediately improve upon excising him from the roster. Still, if there's some funny business going on at the Knicks end, I don't think I really object. I think it might be about time that Steph gets what he's been dishing out all these years.

RESPONSE TO COMMENT IN PREVIOUS BLOG

Alan, first off, if there is any hint in my previous comment that I believe someone else is writing your articles for you then I owe you an apology and want to be clear that I am not challenging your ability to write such a piece. I questioned whether it was you for three resaons only:

1. You now have a number of good writers posting and I do believe that a couple of times when it was someone else posting the “Posted by Alan Hahn” by line appeared at the bottom of the article as it might automatically appear if the name of the poster is not changed on the administration panel. Perhaps I am not paying enough attention.

2. I have been following your impressive work for quite a while (I believe when I really like something I freely say it) and I perceived certain elements which I don’t recall being part of your “style” in the blog post. It had nothing to do with my view of your capabilities; and

3. That Blog Post was the best damn support paper on Walsh’s position and what he intended to do that I have read or heard. It was better than anything Walsh has said in defense of himself and his actions. It was so much better than what has come out of MSG that they should hire you.

But because I liked it, doesn’t mean I agree with it.

With that said, I would never expect you to write an “over the top pro-Marbury” piece but I think it is fair to expect that the news pieces of a writer, who is rising quickly as an international voice of Knicksnewsdom, would provide a more balanced piece than his oft criticized nemesis at the Post. (And actually FI has been pretty balanced on this one. LOL). I am neither a supporter or fan of Marbury’s actions, but to suggest that this current situation is his fault alone is simply bogus.

I think you are certainly in a tough spot because you will always be criticized for working for Cablevision, because you do and they own the Knicks. Their influence is apparent in every article you guys write “the Knicks – who are owned by Cablevision, which also owns Newsday.” It’s gotta suck if you are interested in doing your best reportage. But the truth is you overcome that by being balanced and fair in your news articles at least. Your opinion of Marbury is clear and shared by many, many folks but some of us expect you to be fair as possible in your analysis and reporting even if you don’t have access to one of the principals.

From the cubicle I sit at the blog post was great; the article was not totally fair or balanced.

FINALLY FINED

Finally, some movement. Some answers. Many more questions. Marbury was not suspended for the first “refusal,” so was that a breach of contract? NO No action was taken by Corporate because they didn’t do it right the first time. He was never ordered to play the next two games or told that his services were needed. If so, he would have been fined and suspended. So that question is now asked and answered.

Marbury was suspended for the second refusal after D’Antoni “offered” him the starting job for the entire season instead of a chance to play spot minutes until Mobley was on board. Was that a breach of contract? According to Walsh he suspended Marbury because “he refused the coach’s request to play in the last game.”

Did D’Antoni order Marbury to play? Was D’Antoni required to order Marbury to play or was it enough just to ask? Did they outslick agentless Marbury, by changing the request into a promise that they would use his services for the remainder of the year? Did the Knicks, knowing that Marbury would not play and that D’Antoni did not want him to play, finally trick him into saving them $400,000, the amount of the fine/suspension to be taken out of Marbs pay? Is this a breach of contract or team rules? It looks like we now have an argument. But, it is probably not a breach of contract that an arbitrator would support under the circumstances. It is more likely a face saving move by Corporate so that they don’t look totally idiotic when they either release Marbury or send him home with “all my money” minus the $400,000 five finger discount.

Finally, when Marbury comes back to the team (my guess is he won’t be back) will he be told to play with Quentin and his new teammates? Juicy, juicy, juicy. And if Marbury is not allowed to come back will Walsh save the Knicks more than $400,000 or the $1 Million Marbury offered to forego?

Was all this worth a possible $400,000 savings to the Knicks?

Note: Keep in mind that Marbury has been receiving advice from the NBAPA attorneys every step of the way here for the past few weeks. Would they advise him to breach the contract? Was that offer for full playing time legit or a smart, albiet transparent, chess move to set Marbury up?

O.K., let’s go to the contract. For some odd reason, I happen to have a copy of the Standard NBA Uniform Contract (No I am not an NBA player. LOL.). I don’t have a copy of Marbury’s contract, but it should have the following clauses in it:

Paragraph 20(b) reads, in small part, “The Club may terminate this contract upon written notice to the Player (but only after complying with the waiver procedure. . .) If the Player shall do any of the following:

(3) at any time, fail, refuse or neglect to render his services hereunder or in any other manner materially breach this contract.” and

(e) If this contract is terminated by the Club during any playing season. . . . the Player shall be entitled to receive as full payment hereunder a sum of money which, when added to the salary which he has already received during the season will be [all his money], plus the reasonable traveling expenses of the Player to his home.

Now what about this suspension. Is it legit? Will the Knicks win? Paragraph 4 of my outadate contract says:

“For any violations of [the Club’s reasonable rules for government of players subject to the NBA/NBPA CBA] or for any conduct impairing the faithful and thorough discharge of the duties incumbent upon the player, the club may impose reasonable fines upon the Player. . . .If no Grievance is timely initiated [by the Player], the Club may deduct the amount thereof from any money due or to become due to the Player during the season in which such violation and/or conduct occurred. The Club may also suspend the Player for violation of any rules so established. . . .When the Player is fined or suspended, he shall be given notice in writing, stating the amount of the fine or the duration of the suspension and the reason therfor.”

So now we look forward to the interesting parts:

1. Will they terminate the contract and pay him all but the disputed $400,000 dollars?
2. Can they terminate the contract and simply not pay him since he won’t play?
3. Will Stern step in to resolve this one like he did the Knicks-Larry Brown debacle despite the CBA?
4. What will the press say if the net savings to the Knicks is only $400,000?
5. Will the Knicks bring him back and offer him another opportunity to play and lose $199,400 per game.

I look forward to seeing this play out. But it looks to me as if the Knicks blew it the first time they offered playing time and figured they could get him on a second fake offer. Does anyone believe that D’Antoni would surrender his team and the season to Marbury? Can anyone convince an arbitrator that the Knicks, in the throes of buyout talks, were legitimately offering to change their status with Marbury regarding playing time? I gotta see this. This is hilariously vaudevillian. But thank God they finally made a move.

I am not totally defending stephon. But Dolan refused to buy him out, Walsh lied and said EVERYONE has a clean slate and Dantoni lied about everything from playing him in preason to not speaking to him to telling q whats going on. I manage people and if I talked to another employee about someone else, I am in trouble with human resources . Regardless of his PAST, we are talking about the PRESENT and presently he did nothing wrong. If a person even my boss gives me a choice to do something and I don't want to do it, that is not insubordination. Now if my boss tells me or orders me to do it, I may not like it but if I don't then it is insubordination. Dantoni should ve been a man or boss and demanded he play not ask him if he wants to play.

How exactly is Jerome James injured? Why can't he play? Why aren't we buying out his contract and using that roster space for a guard or PE Jr? Do we really think we can trade JJ anywhere? Perhaps Donnie is keeping the contract to make a trade and make the numbers match up but is it worth watching our team play Roberson 25+ minutes just to keep him on our roster. Forget Marbury, this guy is the biggest waste of salary cap space in Knick history.

I keep reading and hearing that I should buy out Marbury's contract to make this fiasco go away.

I agree Knicks4Life...Roberson is the worse signing ever. I guess they can always say if we didn't have Roberson right now, we would only have 1 guard in Duhon so that's a sticky situation. Of course I would want PE Jr. but that's why they make the big bucks.

I have never and will never be a fan of Marbury because he is a poison and cancer to the team. With that said, he did nothing wrong this year. Dantoni and Walsh were all saying how everybody would be given a chance to prove themselves during training camp and preseason. Everybody would be given a clean slate. It's quite obvious that wasn't the case for Marbury. He's the Knick that actually came in the best shape to training camp. There were no disctractions, no crazy words from Steph, he came in the best shape of his life. In preseason he would easily one of our best players. He seemed to be getting along with Duhon and working well with him on the court. Then out of nowhere, Marbury was left out to dry. Yes we all know he left the team out to dry last year in Phoenix but that was last year. If what Walsh said was true about everybody getting a clean slate, how on God's Green Earth does this guy not get any playing time? Marbury is clearly winning this little battle of wits because that suspension may be upheld but he will get his $400,000 back. The longer this goes on, the more Dantoni will look like a idiot. As I've said before....Walsh better fix this or he may lose the loyalty of Dantoni. Why is Walsh letting this drag on? Stop being a lawyer Donnie....for once.

This incident will cost Walsh Executive of the Year Honors and it may also cost Dantoni Coach of the Year Honors (only if the Knicks make the playoffs).

As previously stated, MARK JACKSON would not have handled Marbury's last year like this. He would have played him for one final year; we would have been an eighth seed, and this would have been a peaceful divorce.

Instead, we are witnessing ANOTHER year filled with drama. But wait, this was not D'Antoni's fault. He thought bringing in Duhon was a great choice to run PG on a losing team; he thought a clean slate meant putting your most expensive player on the bench AND out of position; he does not address the playing rotation with the most expensive player; he tells his most expensive player that he is out of the rotation; he ASKS the player would he LIKE to play, after all the drama from the preseason and first 10 games.

During preseason, Walsh says the player is in "great shape" and looks forward to seeing being a "productive player."

D'Antoni's EGO ruined this season. He wanted to do to Marbury what no previous coach has been able to do: embarrass him.

D'Antoni wins.

But the Knicks better win in the 2010 offseason, or else D'Antoni will be viewed as the loser of the 2008-2011 era.

I can't help but wonder if this whole situation could have been handled better... But I fall back on one thing... For each of the past 10 seasons, pretty much without exception, Marbury has had a meltdown-- with teammates, with coaches, with his own mind. He's shown brief periods of brilliance... the kind of brilliance that makes you wonder why he's not heading to the Hall of Fame. But it never lasts. In the end he has a long list of hollow numbers (probably the least impactful 20 and 8 in NBA history) that point to what could have been. He doesn't make his teammates better. He doesn't listen to his coaches (since Flip Saunders). He isn't upbeat (let's face it he's pretty sullen). I've rooted for him since he was in high school, but enough is enough. I'm tired of talking and writing about him. I wish you the best of luck Stephan. I'm sure you'll tear it up in the European league.

I have 10 web forums and moderate them all. Posters must register first. When I see a wacko post, I simply delete and ban the poster. If knuckleheads register under a different name and make another wacko post, I just delete and ban again. It takes 10 seconds, Alan. The knuckleheads give up and go away.

And Alan, again, it is taking ma many tries (10 at this point) to post this. Please relax the multiple post screening setting.

Guys: if we don't get a moderator the next best thing to do is never respond to wacky posts or even mention a wacko poster's name. Ignoring quiets the baby and he eventually ends up embarrassed knowing he is just playing with himself; responding feeds the baby's fire. If a knucklehead pushes your buttons, laugh it off and go outside and shoot some hoops!

1st..Is it true that Dantoni told Steph that if he played good, the Knicks would sign him for another year?

2nd...If the above question is true...doesn't that mean Dantoni and Walsh are not on the same page?

3rd...How could the Knicks even think of signing him for another year when nobody on the team likes him?

4th...One of the reasons why the Knicks have had a better start this year and more positive energy is because Dantoni exiled Marbury and showed the team he's with them..is that true?

last week we had Jamal and Zach, Splinter was buried and we were above 500.

First time Ive felt good as a Knick fan in years.

No one is coming out of this smelling like roses. Looking forward to putting this episode behind us and talking basketball again.

On my way to the game but let me see if I can help out my friend DaJoka:

(1) I believe he said it and both Marbury and he knew he was lying
(2) Not when it comes to Marbury. He quit on his coach once, this coach will never allow him to infect his team again. To me it is obvious that D'Antoni is trying to force Walsh's hand based on this mess Walsh put himself in.
(3) Alot of people don't like people on their team (see Artest, Rodman or Christan Laettner) but they keep them around based on their talent and/or winning. This is all hype about nothing though, we won't nor were we ever going to resign Marbury. Even if Walsh and D'Antoni would consider it, no way Dolan cuts that check and in this case, he is absolutely right.
(4) I think the great start has more to do with an easy schedule and the team finally having a real "coach". More than anything this team needs stabilty so after we finally sack Marbury and Curry hopefully, this team has a chance to play together for another year without too many more trades unless it involves a real PG and/or shotblocker. Stability will probably produce more wins than anything.

Hope everything is good with you and yours. I think I remember reading you had a seed, hope he or she enjoyed their first Thanksgiving. Off to the garden to cheer Crawford during the intros and then taunt him mercilessly throughout the game, not that he'll hear me from the cheap seats.

A blog is about free speech, not everybody is going to agree with Alan. As long as it is not personal what is the problem? It is when certain people get defensive when someone gives their opinion. If we only posted to agree with Alan and write great post, there would be no reason for comments on the blog.

Alan should make better use of his time, developing sources and digging for a good story than commenting on what people write about here. Post it and move on. No need to moderate.

They do look good in the first half tonight. I know it is Golden State, but still they need to beat these teams.

Regarding moderating the postings - this has nothing to do with agreeing with Alan, but with slinging sophomoric put-downs and insults at other posters. Personal crap, not attacks on an argument. Not too hard to weed out.

Obviously there is no filter for stupidity, like comparing Marbury to corrupt CEO's (defining irrelevant comment), mindlessly criticizing an articulate poster or defending Marbury period. That garbage is up to the reader to skip. Engage with the people who have something to contribute, ignore the half-wits, fanboys and children. I have a theory though - Marbury's defenders find it reassuring that someone can ultimately fail time and again at what they are supposed to do, yet be highly compensated regardless. Sort of like winning the lottery - if that toxic jacka$$ can cash in, there's hope for me!

Tonight's game was another testament to heart and the benefits of an actual system. Props to Duhon and Lee for their performances. And to Crawford, for his 6 for 20 in another Garden loss - like old times.

In their four games with Crawford, the Warriors are giving up 123 ppg. Coincidence? It's amazing how devastating it is to a team when you have a total sieve on the perimeter. And a godsend to have the worst defensive guard in the league playing elsewhere.

Congrats to Coach D'Antoni and the Knicks on the win. David Lee is god!

There was more defense in street games at West 4th.
